ACA Developments

Prior to adjourning for the August recess, Congress passed and President Barack Obama signed into law (on July 31, 2015) the Hire More Heroes Act as part of H.R. 3236, the Surface Transportation and Veterans Health Care Choice Improvement Act of 2015. The law is focused on surface transportation programs but affects rules regarding how to count employees under the Affordable Care Act (ACA) as well as health savings account (HSA) eligibility for individuals receiving care through the Department of Veterans Affairs. What Employers Need to Know The Surface Transportation and Veterans Health Care Choice Improvement Act amends the Internal Revenue Code to exclude individuals covered for medical care under TRICARE or the Department of Veterans Affairs from the determination of whether an employer is an applicable large employer. Last week, House Judiciary Committee Chairman Bob Goodlatte (R-VA, pictured) introduced legislation titled the Safe Harbor for Reporting Violent Behavior Act of 2016 (H.R. 4532). The bill, which is pending for the committee, would provide a safe harbor from lawsuits to those employers that, in good faith and based on objectively reasonable suspicion, make a report about violent or threatening behavior by an employee or former employee to a potential future employer. The bill is modeled after a 2007 law that provides a safe harbor from lawsuits to those who report suspicious behavior on public transportation systems. In a letter of support, SHRM explained how in an effort to minimize exposure to liability, employers currently may limit the amount of information they share as part of a reference check to only confirming dates of an individual’s employment and the positions the individual held.  Capitol Hill Update  Overtime Rule Heating Up on Capitol Hill After significant outreach from the SHRM A-Team, an impressive 108 bipartisan members of Congress signed a congressional support letter to Department of Labor (DOL) Secretary Tom Perez expressing serious concerns with the proposed overtime rule. In the letter, congressional leaders urged the DOL to reconsider moving forward with the rule as drafted, noting the unintended consequences for both employees and employers. Lawmakers also noted that the proposal does not clearly explain the DOL’s plan regarding the duties test.
